1. What Is This Lawsuit About?

The lawsuit alleges the Miley Cyrus-branded jewelry contained cadmium, which the Plaintiffs claim posed a danger to its wearers and would not have been purchased by them if they knew such information. Defendants have denied and continue to deny any and all allegations of wrongdoing and liability. The Court has not decided which side is right.

2. How Do I Know If I Am Included In The Settlement?

You are a Settlement Class Member if you purchased Miley Cyrus-branded jewelry from a Wal-Mart retail store in the United States after July 1, 2005.

4. How Could I Have Participated In The Settlement?

Members of the Settlement Class could have submitted claims for refund of purchase price.

All claims must have been received by March 12, 2014 to be considered timely and valid.

5. How Can I Receive Reimbursement For Shipping Product To The Claims Administrator?

Wal-Mart and BCBG will pay Settlement Class Members who submitted a claim by mailing Products to the Claims Administrator and whose claims were approved (a Qualifying Member) an amount to refund or defray the cost of mailing the Products. That amount shall be paid from a separate amount of $25,000 that Wal-Mart and BCBG shall pay to the Claims Administrator. The Claims Administrator shall allocate from this $25,000 an amount that will repay the actual cost of mailing the Product to the Claims Administrator for each Qualifying Member. In the event that the $25,000 is not sufficient to pay all costs of mailing the Products, the Claims Administrator shall pay the $25,000 pro rata to each Qualifying Member based on the actual cost of mailing the Products paid by each Qualifying Member.

6. What Rights Am I Giving Up By Agreeing To The Settlement?

All Class Members who did not timely exclude themselves from the Settlement shall be deemed to have released Defendants from any and all liability with respect to all claims arising out of or relating to the purchase of Miley Cyrus-branded jewelry from a Wal-Mart store, except personal injury claims.

7. How Could I Have Excluded Myself From The Settlement?

Any Class Member who wished to be excluded from the Settlement and not be bound by the Agreement must have done so by filing with the Court and serving a written notice to opt out of the Settlement by December 16, 2013:

8. How Could I Have Objected To The Settlement?

Class Members who did not request exclusion may have objected to the Settlement. Class Members who chose to object must have filed objections with the Court, with copies to the Settlement Class Counsel and Defendant's Counsel no later than December 16, 2013.

10. When Did The Court Decide To Approve the Settlement?

The Court held a Final Approval Hearing on December 30, 2013. At this hearing, the Court considered whether the Settlement, including the proposed award of attorneys' fees, costs, and expenses to Class Counsel and a reasonable incentive reward to the Class Representative, should be approved as fair, reasonable, and adequate. The Court approved the Settlement.
